Código Penal obliga centros de salud a fortalecer acreditación
El doctor Severo Mercedes hizo la advertencia este 31 de julio del 2026.
SANTO DOMINGO.- El doctor Severo Mercedes, jefe de la Residencia Nacional de Cirugía Plástica Reconstructiva y Estética (RENACIP), advirtió que la entrada en vigencia del nuevo Código Penal Dominicano obliga a las instituciones de salud a fortalecer sus procesos de acreditación, cumplimiento normativo y responsabilidad institucional.
Mercedes, quien fue prologuista del libro “Plan de Cumplimiento Penal para el Sector Salud”, del abogado especialista en Derecho Médico Gilberto Objío Subero, explicó que la nueva legislación representa una transformación profunda para el sistema sanitario nacional.
Afirmó que, mientras para otros sectores productivos el Código Penal constituye una actualización regulatoria, para el área de salud implica una redefinición del marco jurídico médico institucional, debido al nivel de exposición a riesgos, errores humanos y responsabilidades legales.
“Pocas actividades económicas combinan, como lo hace la actividad sanitaria, una exposición tan alta a la falla humana, a la presión regulatoria y ahora a la imputación penal directa”, expresó.
DIRECTIVOS Y CONSEJOS DE ADMINISTRACIÓN
El también jefe del Departamento de Cirugía Plástica del Hospital Salvador B. Gautier señaló que el cumplimiento penal dejará de ser una obligación administrativa para convertirse en un elemento esencial para la permanencia y protección de clínicas, hospitales, laboratorios y demás entidades vinculadas al sector.
Indicó que la nueva normativa establece que la responsabilidad penal de los directores de centros de salud podrá extenderse a los consejos de administración, que tendrán el deber de supervisar y regular las prácticas institucionales.
Mercedes llamó a los profesionales de la medicina a prepararse para un escenario de mayor judicialización de los conflictos surgidos en la relación médico-paciente.
El especialista, quien además es abogado y magíster en Derecho Médico, recomendó la obra como una herramienta de orientación doctrinal y operativa para las instituciones sanitarias y administradoras de riesgos de salud.
La puesta en circulación del libro se realizó en la sede de FUNGLODE, con la participación de representantes del ámbito jurídico y del sector salud.
