De 5 a 10 años de prisión, la cancelación hasta de por vida del exequátur y demandas en daños y perjuicios por difamar o extorsionar
ANALIZANDO EL NUEVO CÓDIGO PENAL
Las sanciones pueden abarcar al medio donde se produzca la difamación o extorsión con el cierre definitivo o temporal.
Millones de dominicanos se han mantenido al margen de la creación de las leyes, tal vez no les interesaba o como dice una frase están “en Belén con los pastores”, les han metido varios strikes y ni cuenta se han dado con la aprobación del nuevo código penal, (ley 74-25), el cual a partir del seis (6) de agosto del año 2026, ya usted no le podrá decir «ladrón» a ningun ladronaso!!! porque ese ladrón se va a ofender y si usted no tiene pruebas entonces el ladrón se va a querellar y tratará de hacerte caer preso a ti aunque tu solo le digas la verdad, pero de la cual no tienes pruebas, ya que todas las personas serán sujetos obligados de la ley cuando entre en vigencia en nuevo Código Penal en la República, por un lado con grandes avances, retrocesos, aumentos de penas, la configuración de delitos nuevos, la figura del cúmulo de penas, una nueva modalidad de cumplimiento de las penas, entre otras novedades que el país aún desconoce y que deberían saber porque este código le va a dar muy duro a las personas, ya que trae penas bastante severas y será necesario construir varias cárceles nuevas porque las que hay no van a dar abasto.
Especialmente todas las personas dedicadas a los medios de comunicación deben leer este código, ya que una de las figuras nuevas que trae, lo constituye el hecho de que el artículo 208 del nuevo código penal, (ley 74-25), contempla penas de manera inicial de 2 a 5 años de prisión correccional y multas de 9 a 15 salarios, para todas las personas, más aún los que trabajan en medios de comunicación cuando sean acusados por el Ministerio Público de Difamación, difamación extorsiva e injuria, cuando dispone lo siguiente;
“Artículo 208.- Difamación. Constituye difamación la alusión o imputación pública a una persona, física o jurídica, de un hecho preciso o concreto que le afecta en su honor o en su consideración, buen nombre, imagen, dignidad e integridad familiar, por cualquier forma pública, audiovisual o escrito, radial o televisivo, streaming, electrónicos o en el ciberespacio”.
Párrafo.- La difamación será sancionada con penas de 2 a 5 años de prisión menor y multa de nueve a quince salarios mínimos del sector público, además de las penas complementarias y medidas socio judiciales correspondientes.
“Artículo 209.- Difamación extorsiva. Quien haga imputación pública a una persona, física o jurídica, de un hecho preciso o concreto que le afecta en su honor o en su consideración, buen nombre, imagen, dignidad e integridad familiar, por cualquier forma pública, audiovisual o escrito, radial o televisivo, streaming, electrónicos o en el ciberespacio, con el propósito de obtener para sí o para un tercero, un beneficio de cualquier naturaleza, o para que la víctima o un tercero realice, omita o tolere un acto que le cause un perjuicio, y con ello obligue o procure obligar a la víctima a ceder a sus exigencias, será sancionado con penas de 5 a 10 años de prisión mayor y multa de diez a veinte salarios mínimos del sector público”.
Párrafo I.- La misma pena se impondrá a quien para no materializar la difamación solicite un beneficio de cualquier naturaleza, o para que la víctima o un tercero realice, omita o tolere un acto que le cause un perjuicio, y con ello obligue o procure obligar a la víctima a ceder a sus exigencias.
Párrafo II.- Si la infracción es cometida por dos o más personas, sin importar que estos formen o no una asociación de malhechores se impondrá pena de 10 años de prisión mayor y multa de veinte a treinta salarios mínimos del sector público.
Artículo 210.- Injuria. Constituye injuria el hecho de pronunciar públicamente contra otra persona, física o jurídica, una invectiva o cualquier expresión afrentosa o despreciativa, siempre que no contenga la imputación de un hecho preciso, por cualquier medio, audiovisual o escrito, radial o televisado, streaming, electrónicos o en el ciberespacio.
Párrafo.- La injuria será sancionada con penas de 15 días a 1 año de prisión menor o multa de uno a dos salarios mínimos del sector público o ambas sanciones.
Artículo 212.- Responsabilidad de las personas jurídicas en casos de difamación e injuria. Las personas jurídicas podrán ser declaradas penalmente responsables de las infracciones definidas en los artículos 207 al 210, (por cierto muy amplias), en las condiciones previstas en los artículos 8 al 11, en cuyo caso serán sancionadas con las penas dispuestas en el artículo 39.
Artículo 213.- Penas complementarias aplicables a las personas físicas imputables y jurídicas responsables. A las personas físicas imputables y jurídicas responsables de las infracciones definidas en los artículos 186 al 190 y del 198 al 210, se les podrá sancionar, además, con una o varias de las penas complementarias dispuestas en los artículos 30, 34, 38, 41 y 45.
Con esta nueva disposición el Ministerio Público podrá lograr la revocación parcial o definitiva del exequátur de cualquier persona acusada de cometer delitos graves y muy graves, etc. etc. etc., además del cierre parcial o definitivo del medio desde el cual se realiza la difamación, la difamación extorsiva o la injuria.
Ya que los artículos 30, 34, 39 y 41 del nuevo Código Penal (ley 74-25), establecen lo siguiente;
“Penas complementarias por infracciones leves, graves y muy graves. Las penas complementarias aplicables a las personas físicas imputables de infracciones muy graves son las siguientes”:
2) El cierre definitivo del establecimiento comercial o de la instalación involucrada directa o indirectamente en la infracción, o su cierre temporal por un periodo no mayor de tres años;
4) La inhabilitación definitiva para ejercer la función pública o actividad profesional o social en cuyo ejercicio se cometió la infracción que da lugar a la condena, o la inhabilitación temporal para ejercerla por un periodo no mayor de cinco años;
7) La revocación de la licencia o título público habilitante.
