SANTO DOMINGO.– El secretario nacional electoral del Partido Fuerza del Pueblo, Henry Merán, criticó la decisión del Tribunal Superior Electoral (TSE) de declinar hacia el Tribunal Constitucional (TC) el recurso contra la resolución de la Junta Central Electoral (JCE) que prohíbe la publicación de encuestas de opinión con fines electorales fuera del período establecido por la ley.
Opinó que el TSE “se fue por la tangente” y evitó asumir la responsabilidad de conocer el fondo del caso, al considerar que los magistrados de esa alta corte tenían conocimiento de la competencia que les correspondía en torno al tema.
“Con esta decisión, el Tribunal Superior Electoral escurrió el bulto, eso está claro. Lo saben los honorables magistrados del tribunal y lo saben los abogados de la República que manejan este tema”, expresó.
CRITERIOS POLÍTICOS MÁS QUE JURÍDICOS
Durante una entrevista en el programa Ahora por la Mañana, transmitido por la emisora 107.7 FM, sostuvo que la decisión del TSE de declararse incompetente responde a criterios políticos más que jurídicos, y que ahora el Tribunal Constitucional podría emitir una sentencia de equilibrio debido a la naturaleza del conflicto.
La JCE prohibió mediante resolución difundir o publicar, por cualquier plataforma o medio de comunicación, encuestas de opinión con propósitos electorales fuera del cronograma legal de precampaña, período que se inicia formalmente el primer domingo de julio del año previo a las elecciones.
La medida ha sido cuestionada por sectores políticos y jurídicos, quienes debaten sobre el alcance de las facultades de la Junta Central Electoral y los límites establecidos para la divulgación de estudios de opinión durante los procesos electorales.
