El TSE declina ante TC recurso contra reglamento de encuestas
Audiencia del TSE.
SANTO DOMINGO.- El Tribunal Superior Electoral (TSE) se declaró incompetente de oficio para conocer el “Recurso Contencioso en nulidad contra la resolución núm. 14-2026”, emitida por la Junta Central Electoral (JCE) el 22 de mayo de 2026, y dispuso declinar el expediente ante el Tribunal Constitucional Dominicano.
La acción buscaba anular el reglamento aprobado por la JCE que establece el procedimiento para el registro de firmas o empresas encuestadoras y la publicación de encuestas en materia electoral.
La decisión fue adoptada por los magistrados Ygnacio Pascual Camacho Hidalgo, presidente del TSE; Fernando Fernández Cruz y Rafaelina Peralta Arias, quienes determinaron que la solicitud presentada constituye una acción de control concentrado de constitucionalidad, competencia exclusiva del Tribunal Constitucional.
EXPEDIENTES FUERON FUSIONADOS POR CONEXIDAD
El TSE ratificó la fusión de los expedientes TSE-01-0013-2026 y TSE-01-0014-2026, realizada durante la audiencia del 9 de junio de 2026, al considerar que existía conexidad entre las partes, las causas y la relación de dependencia entre ambos procesos.
La alta corte precisó que la pretensión planteada cuestiona la constitucionalidad del artículo décimo tercero del reglamento sobre encuestas electorales, por lo que corresponde al Tribunal Constitucional conocer y decidir el fondo del asunto, conforme a la Ley 137-11 Orgánica del Tribunal Constitucional y de los Procedimientos Constitucionales.
Asimismo, el tribunal declaró inadmisible la solicitud de medidas cautelares presentada por la parte impugnante, al considerar que, una vez resuelta la falta de competencia, resultaba innecesario analizar dichas medidas por carecer de objeto.
Las costas del proceso fueron declaradas de oficio. El TSE ordenó la notificación de la sentencia a las partes mediante la Secretaría General y dispuso su publicación en el portal institucional y en el Boletín Contencioso Electoral para los fines correspondientes.
